The practice of law has always required the application of substantive legal knowledge and sound judgment in service of a client's cause, governed above all by adherence to a strict code of professional ethics and responsibility.  However, over the past twenty five years an explosion of new substantive laws and regulations, dramatic changes in law firm structures and the business of providing legal services, widespread changes in technology, and heightened client expectations have placed increased professional and ethical demands on the practicing lawyer.  The law of lawyering grows more complex and, frequently, lawyers find their professional actions and judgment subject to attack by clients, adversaries, courts, and disciplinary bodies.

Pepe & Hazard regularly provides advice to attorneys and law firms seeking counsel as to whether or not the applicable Rules of Professional Conduct permit or prohibit a contemplated course of action (e.g., the formation of a 'law-related business;' the navigation of conflicts of interest; whether one is required to report certain conduct to the applicable ethical authorities; the structure of law firm alliances, mergers and/or dissolutions; etc.).  We assess whether past conduct has violated the requirements of professional ethics and responsibility.   We defend attorneys and law firms accused of professional errors and omissions (e.g., legal malpractice; breach of contract; breach of fiduciary duty; etc.), or who are the subject of a disciplinary proceeding.  We also provide advice as to matters involving insurance coverage for alleged professional malpractice.
